1. Agreeing to these Terms

These Terms of Service (the "Terms") set out the rules for using our website. In them, John & Mary Copper is referred to as "we", "us" or "our", and "our shop" means this website together with all the information, tools and services available on it.

We offer our shop to you only on condition that you accept everything set out here: every term, condition, policy and notice.

Visiting our shop or buying from us counts as using it, and when you do, you agree to these Terms, including any extra terms, conditions and policies they refer to or link to. They apply to every user, including, without limitation, people who browse, vendors, customers, distributors and anyone who contributes content.

Please read the Terms carefully before you use our shop. Using or accessing any part of it means you accept them. If you don't accept all of them, you must not use our shop or any of our services. If these Terms are treated as an offer, you can accept that offer only on these Terms and on no others.

New features or tools we add to our shop are covered by these Terms as well.

When we change these Terms

The current Terms are always on this page for you to read. At our sole discretion, we may revise, change or replace any of them by posting the changes on our website. Checking this page from time to time is your responsibility. Continuing to use or access our shop after changes are posted means you accept them. If a change is material, we'll say on this page that the Terms have been updated, so you know which terms we're applying.

2. Rules for using our shop

By agreeing to these Terms, you confirm that you're legally an adult (you have reached the age of majority) in the state or province where you live, or that you're an adult there and have given us consent for minor relatives of yours to use this site.

When using our shop, you must not:

use any of our products for a purpose that's illegal or that we haven't authorized;
break any law that applies where you are, including copyright law;
send us, or upload, worms, viruses or any other destructive code;
copy, duplicate, reproduce, sell, resell or otherwise exploit any part of our shop, its use or access to it, or any contact on this website used to provide our services, without our express written permission.

Breaking or violating any of these Terms will end your use of our services immediately, and you may be liable to us for any loss or damage your breach causes us.

We may refuse service to anyone at any time, and we don't have to give a reason.

How data moves

Anything you submit other than credit card details may travel unencrypted, which can involve (a) passing across a number of networks and (b) being changed to fit the technical needs of the networks or devices along the way. Credit card details are always encrypted when sent over a network.

3. Prices, products and orders

Prices and changes to our shop

Prices can change without notice. We may also alter or stop running our shop, or any part or content of it, whenever we choose and without notice. If we change prices or modify, suspend or discontinue our shop, we won't be liable to you or anyone else.

Our products

Some products or services may only be sold online through this website. Quantities may be limited, and you can return or exchange them only as our Refund Policy allows.

We've tried our best to show product colors and images accurately, but we can't promise your screen will show any color exactly as it is.

We may restrict who can buy our products or services, by person, geographic region or jurisdiction, deciding case by case, though we're under no obligation to do so. We may cap the quantity of anything we offer, change product descriptions or prices whenever we choose without notice, and stop selling any product at any time. Where an offer on this site is prohibited by law, it is void.

We make no promise that any product, service, information or other material you buy or obtain from us will meet your expectations for quality, or that we will fix any errors in our shop.

Orders and your details

We can turn down any order. At our sole discretion, we can limit or cancel how many items one person, household or order may buy. That can include orders that share a customer account or a credit card, and orders using the same billing or shipping address. If we change or cancel your order, we may try to tell you using the email address, billing address or phone number you gave when ordering. We may also limit or block orders that look to us, in our sole judgment, like they come from resellers, retailers or distributors.

When you buy from us, you agree to give us accurate, complete and up-to-date information about your account and every purchase you make in our shop, and to keep it updated promptly, including your email address, card numbers and expiry dates, so that we can process your orders and reach you if we need to. Mistakes on our site

Occasionally our site may contain typos, inaccuracies or omissions, for example in product descriptions, prices, promotions, offers or shipping charges. We may fix these, update or change information, or cancel orders if something on our site or a related website is inaccurate. We can do this at any time without telling you first, even after you've placed your order.

Apart from what the law requires, we're under no duty to update, clarify or amend information on our site or any related website, including prices. A specified update date in our shop should not be read as meaning that everything on our site or a related website has been changed or updated.

4. Information on our site

We aren't responsible if information on our site isn't accurate, complete or up to date. It is there as general information only. Before relying on it or basing a decision on it alone, check original sources that are more accurate, fuller or more current. Relying on anything on our site is at your own risk.

Some of what's on our site may be historical. Historical information isn't necessarily current and is given only for your reference. We may change our site's content at any time but aren't obliged to update it, and you agree that keeping an eye on changes to our site is up to you.

5. Other companies' tools and websites

We may give you access to tools made by third parties that we don't monitor and have no control over or input into. You accept that we offer access to them "as is" and "as available", with no warranty, representation, condition or endorsement of any kind, and that we accept no liability at all for anything arising from or connected with your use of them. Using any optional tool available through our site is entirely your own choice and risk, and you should make sure you know and approve the terms on which its provider or providers offer it.

In future we may offer new services or features through the website, such as new tools and resources, and these Terms will cover them too.

Some content, products and services you can reach through our shop may include material from third parties. Links on our site may lead to outside websites run by third parties with no connection to us. We don't examine or evaluate their content or accuracy, and we give no warranty and take no responsibility or liability for any third-party websites or material, or for anything else third parties provide, such as products or services.

We aren't liable for any harm or damage connected with buying or using goods, services, resources or content, or with any other transaction, through a third-party website. Before you deal with a third party, read its policies and practices carefully and be sure you understand them. Please send any complaints, claims, concerns or questions about third-party products to that third party.

6. Ideas, reviews and other things you send us

You may send us ideas, suggestions, proposals or other material, whether online, by email, by post or any other way (we call these "comments"). By sending them, you agree to let us use, edit, copy, translate, publish and distribute them in any medium, whenever we like and without restriction. We don't have to (1) keep any comments confidential, (2) pay for any comments, or (3) reply to any comments.

We may review, edit or take down any content that we decide, at our sole discretion, is offensive, threatening, defamatory, libelous, obscene, pornographic, unlawful or otherwise objectionable, or that infringes these Terms or the intellectual property of anyone, but we have no duty to do so.

You promise that your comments won't infringe anyone's rights, such as rights of privacy or personality, copyright, trademark or other personal or proprietary rights. You also promise they won't include anything libelous, abusive, obscene or otherwise unlawful, and won't contain malware of any kind, including computer viruses, that could disrupt how our shop or any related website works. You must not give a fake email address, impersonate anyone, or in any other way mislead us or others about where a comment came from. You alone are responsible for your comments and whether they are accurate. We accept no responsibility or liability for comments posted by you or by any third party.

7. Your personal information

Our Privacy Policy covers any personal information you submit through our site.

8. Text messages

When you give us your mobile number, you agree that John & Mary Copper may send you recurring automated texts, both marketing messages and updates about your orders.

Agreeing to receive texts is not required to buy anything from us.
Mobile carriers aren't liable if a message is delayed or never arrives.
The number of texts we send varies.
Your carrier's standard charges for messages and data may apply.
Text STOP to us at any time to unsubscribe, or text HELP if you need assistance.
We won't give your mobile information to third parties or affiliates for them to use in marketing or promotion.

9. No warranties

We don't guarantee, represent or promise that our shop will always run without interruption, on time, securely and free of errors, or that anything you get from using it will be accurate or reliable. We may also take our shop offline for indefinite periods, or close it at any time, without telling you, and you agree that we may do so. You expressly agree that you use our shop, or are unable to use it, entirely at your own risk.

Unless we expressly say otherwise, our shop and all the products and services we deliver to you through it are provided for your use on an "as is" and "as available" basis, without any kind of representation, warranty or condition, whether express or implied. Without limiting this, we disclaim every implied warranty or condition of merchantability, merchantable quality, durability, title, non-infringement and fitness for a particular purpose.

10. Limits on our liability

In no event will John & Mary Copper, or any of our directors, employees, agents, partners, licensors or service providers, be liable for any injury, claim or loss, or for direct, indirect, incidental, special, consequential or punitive damages of any kind. This includes, without limitation, loss of profits, revenue or savings, lost data, the cost of replacement goods, and any similar damages.

This is true whatever legal basis a claim relies on, whether negligence or another tort, contract, strict liability or anything else. It covers claims that arise from your use of our shop or of any product obtained through it, and any other claim connected in any way with your use of our shop or any product. It also covers mistakes or omissions in any content, and damage or loss of any kind resulting from use of our shop or of any content (or product) posted, sent or otherwise made available through it, even if we had been told such damage was possible.

As far as the law allows, our liability will never be more than what you paid for the product the claim relates to.

11. Indemnity

You agree to defend, indemnify and hold harmless both John & Mary Copper and our employees, interns, agents, partners, suppliers, subcontractors and service providers, as well as our parent companies and subsidiaries, against any claim or demand by a third party, including reasonable attorneys' fees, that arises because you breached these Terms or any document incorporated into them by reference, or because you broke a law or infringed someone else's rights.

12. Ending this agreement

These Terms remain in force until you or we end them. You can end them whenever you like by telling us you don't want to use our services any more, or simply by no longer using our site.

If we judge, at our sole discretion, that you've failed to follow any part of these Terms, or we reasonably suspect you have, we may also end this agreement at any time. You will then still be responsible for paying everything you owe through the termination date, and we may refuse to let you use our services, in whole or in part.

Obligations and liabilities that either of us took on before the end date continue to apply, for all purposes, after this agreement ends.

13. Governing law and other legal terms

Governing law and courts

These Terms are governed by the law of the place where the company that runs this shop is registered, and no conflict-of-laws rules will be used to apply any other law. Any action, or any claim in equity, that arises from or relates to these Terms may be brought only in the courts of that place, which have exclusive jurisdiction to decide it.

If part of these Terms can't be enforced

If any provision of these Terms is held unlawful, void or unenforceable, it will still be enforced as far as applicable law allows, and any part that can't be enforced will be treated as removed from these Terms. That won't affect the validity or enforceability of the remaining provisions.

Entire agreement and waiver

If we don't exercise or enforce any of our rights under these Terms, or any provision of them, that is not a waiver, and it doesn't mean we've given that right or provision up.

These Terms, along with any policies or operating rules we post on this site or about our services, form the entire agreement between you and us and our entire understanding. They govern your use of our shop and replace all agreements, proposals and communications between you and us, oral or written, made before or at the same time, including any earlier versions of these Terms.
